Terms of Service

You will agree with the Terms of Service if you commission me. We agree on a oral purchase contract, which can be legally prosecuted.

Terms of Service:

Generally:

Every drawing is watermarked. It won't be removed and stays there.
The progress might be recorded and uploaded to Youtube or other plattforms as a speedpaint.
The prices are for orientation and might change depending on the commission. You can always discuss the price with me.
I have the right to reject a commission if I am not comfortable with it.
I have a waiting list which will be processed in order. The order follows after who commissioned me first. If your commission has a deadline (birthdays, holiday) it's possible to be preferred.
I will always inform on social media if I am open for commissions or not.

Payment:

PayPal and bank transfer, euro(€).
All Commissions must be payed before. (I can agree to split the payment)
Don't send me money before I agreed, gave you the commission slot and asked you for the payment

Process and Recievement:

You will be notified when I started with your commission and loose the right of refund.
While progressing I will send you updates for you to tell me, if it matches your expectations. (the WIP's always will be watermarked)
The progress of a commission can be a few days until up to 2 months, depending on different factors like my health, persional issues or other work. (I will notify you if I take longer)
As soon as your commission is finished, you will get the whole picture via Email, to keep the full quality.
There will be no physical product, everything is digital!

Changes or Corrections:

There will be no changes in the final artwork, only if there was a misunderstanding from my side.
If you wanna change something you were happy with before, I will charge you extra money for it.
If your reference for change is too unclear it will cost extra money too.

Copyright and Usage:

I have the full right on the picture and can use it for my own purpose. For example to promote myself, or to sell products in my shop.
The buyer is allowed to use the commission for personal use, like social media, websites etc. (Credits still would be nice).
The buyer ISN'T allowed to use the picture for hateful or offensive purposes.
The buyer ISN'T allowed to make profit with the picture or use it as NFTs.
The buyer ISN'T allowed to credit the picture as their own.
The buyer ISN'T allowed to "finish" a sketch commission of me on their own and describe it as a "Collab with Vampauli".

Copyright violation: duplication/usage of a commission in a comercial way (making money in any possible way), Claiming an artwork as your own, removing my watermark or artist signiture, changing the artwork without my permission.
I can allow the buyer individually if they can use it in a comercial way and will, if we discuss it in detail.

Return and Refund:

The buyer ISN'T allowed to ask for refund, as soon as I started with the commission.
You will get a compleate refund if I am not able to start the commission (any possible reasons).
You will get a refund if you deny your order before I will start the commission.
If you request a refund, wait until I will send the money back to you. Don't send me a request on Paypal.
If you send me a Paypal refund request in any part of the progress where you are not allowed to do that, you will loose every right on the picture. I will have the right to do with this picture everything I want to. For example; deleting it, redraw it for myself and use it etc.
+ I will deny the request of refund and show our chats to Paypal to proof that it's your commission and that we had a contract. You will also be blocked and put on a blacklist for future commissions.
